Representative Achievements 2007 – 2008

• Obtained the reversal of a damages award against our client, a commercial real estate developer, in the Massachusetts Appeals Court;
• Successfully settled a wrongful death case against our client in Florida and then obtained 100% of the settlement funds from an insurer in a related coverage dispute;
• Obtained summary judgment for our client in a business dispute and then successfully prosecuted an abuse of process counterclaim to recover our client’s legal fees and expenses;
• Vacated default judgment against our client and obtained dismissal of eviction proceeding against him as part of our pro bono work;
• Successfully settled a will contest with our client beneficiaries receiving the contested will proceeds;
• Obtained dismissal of professional liability claims against client electrician and company pending before Division of Professional Licensure without issuance of any penalty;
• Successfully resolved a copyright infringement claim against a builder in a Federal Court proceeding;
• Obtained recovery of a Town’s overtime expenses incurred when a negligent driver caused an accident with a fire truck, and injured a fireman, resulting in additional wage costs to the Town;
• Obtained a defense verdict in a case where liability was stipulated at the trial involving severe personal injury claims;
• Obtained the dismissal of a construction subcontractor’s payment claim against our general contractor client;
• Obtained the dismissal of a Complaint and dissolution of liens on multiple client properties asserted by a national HVAC supplier;
• Successfully and cost effectively obtained full payment for a material supplier client in a claim against construction subcontractor where the subcontractor claimed the materials were defective and had caused property damage and repair costs;
• Successfully arbitrated and mediated employment and labor disputes in Wisconsin and throughout New England;
• Successfully and cost effectively obtained full payment for a subcontractor demolition client in claims against a general contractor and owner for demolition services provided on a construction project;
• Obtained dismissal of contractor’s indemnification and fraud claim against a project developer arising from the developer’s termination of the general contractor;
• Obtained release of home owner’s defective work claim asserted against residential construction client with no payments being made to home owners;
• Obtained a six figure attachment on a general contractor principal’s real estate to secure future judgment for our real estate developer client against general contractor; and
• In a matter involving alleged defective construction in a multi-party matter, we obtained full payment of defense costs and attorney’s fees from our client’s insurer despite disputed coverage and then settled the case with our client and its insurer paying nothing into the settlement.
